Newburgh Murder Suspect Who Allegedly Strangled Attorney in Court Assigned New Lawyer

A Newburgh man on trial for a 2020 fatal stabbing has been assigned a new attorney after allegedly attacking his former lawyer during court proceedings last week, prompting a mistrial.

Arthur Thomas appeared in Orange County Court in Goshen on Tuesday, escorted by sheriffs and wearing handcuffs and shackles. The outburst, which reportedly took place last Friday during the second day of testimony, led to the immediate suspension of the trial.

Thomas is accused of suddenly grabbing and strangling his court-appointed attorney, Matthew Witherow, bringing him to the ground before being restrained by court officers. A juror who witnessed the event described the attack in an exclusive interview with News 12.

Despite the shocking incident, Witherow—who also serves as a part-time judge in Port Jervis—was unharmed. Speaking with News 12, he reaffirmed his dedication to his profession.

“I’m used to fighting for my clients on a daily basis. Notwithstanding what happened here, my commitment to these ideals is unwavering,” Witherow said.

During Tuesday’s hearing, Judge assigned Joe Artrip as Thomas’s new defense attorney. While News 12 reached out to Artrip for comment, he has not yet responded.

Thomas was standing trial for allegedly stabbing a man to death in Newburgh in 2020. Authorities have not yet confirmed whether he will face new charges stemming from the alleged courtroom attack.

A new trial date will be scheduled, and a fresh jury will be selected. Thomas is expected to return to court on June 10.
