Stepdad Fatally Shoots Adult Stepson After Fortnite Dispute Involving Agitated 9-Year-Old, Police Say

A Florida man faces a second-degree murder charge after allegedly shooting and killing his adult stepson during a domestic dispute sparked by the video game Fortnite.

Kelly Garcia, 43, was at home in Davenport, Florida, on Wednesday evening with his wife, Adriane Daza, 48, her 26-year-old son, Azareel Martinez, and her two younger children, ages 9 and 11.

According to Davenport police, the 9-year-old had been caught playing Fortnite, a game his parents had banned. When Garcia took away his cellphone as punishment, the boy reportedly retrieved a Smith & Wesson 9 mm handgun from a nightstand in his parents’ bedroom.

Police said Garcia managed to take the weapon from the child. At that moment, Martinez entered the room, noticed the boy was visibly upset, and began defending him. In response, Garcia allegedly shot Martinez multiple times in the chest and stomach.

As Martinez tried to escape, Garcia reportedly shot him two more times in the back. Martinez collapsed and was later taken to a nearby hospital, where he died from his injuries.

Police arrived at the home in the Citrus Landing neighborhood around 7:10 p.m. The Polk County Sheriff’s Office assisted with what authorities described as an “extensive” crime scene investigation. Garcia was charged with second-degree murder and unlawful storage of a firearm accessible to a minor. He remained in the Polk County jail as of Thursday morning.

Davenport, located about 30 miles southwest of Orlando in Polk County, is where the tragic incident unfolded. In Florida, a conviction for second-degree murder can carry a maximum sentence of life in prison.
